Facua - Consumers in Action has reported to Brussels the new electricity bill for violating EU directives on electricity, consumer rights and unfair terms , said in a statement . The association expects the European Commission to intervene , file a stoppage of Spain and " chaotic tariff model imposed by the Government " occurs.
The complaint was forwarded to the President of the European Commission , José Manuel Durão Barroso, and affects " a tariff and billing formulas that violate the rights of users established in the legislation of the European Union , binding on the United members. "
Facua think that is a " clear discrimination " among consumers to different conditions apply depending on the type of meter you have . In this circumstance, " the lack of transparency on prices , which are not disclosed to users before implementation and are hardly understandable to the majority " is added . These aspects , points out, contrary to Article 3 of Directive 2009/72/EC concerning common rules and requiring that electricity prices are "reasonable , easily and clearly comparable, transparent and non-discriminatory ."
The association also notes that the method of calculating the price violates basic elements of nature in matters of consumer protection in the EU to include rates that "vary substantially without marketers sending information about it before."
unfair terms
The second of the policy is violated , according to Facua the 93/13/EC on unfair terms in consumer contracts . This standard considers abusive clauses aimed " to provide that the price of goods is determined at the time of delivery, or give the seller of goods or service provider the right to increase prices, but in both cases the consumer the corresponding right to cancel the contract if the final price is much higher than the price agreed to conclude the contract . "
Finally , consider that the Directive 2011/83/EU of the European Parliament and Council is violated , of 25 October 2011 on the Rights of Consumers. In it , it states that " before the consumer is bound by a contract," provider " should provide a clear and understandable to the consumer " or " the total price of the goods or services, including taxes, or if the price can not reasonably be calculated in advance "because of its nature, " the way in which the price is determined .
