The Central Court of Instruction No. 2 of the High Court declared admissible the complaint filed by the Anticorruption Prosecutor against five officials of Novacaixagalicia - four have already left the institution and one is still active - for the amounts awarded in respect of early retirement , according to the order made on Tuesday.
The circuit judge Ismael Moreno concludes that the facts referred the complaint "are of 'prima facie' and subject to further characterization, characters of crime, and should therefore be admissible admission and practice of measures corresponding research ". The High Court thus assumes the authority to investigate four of Novacaixagalicia exdirectivos (José Luis Pego, Gregory Gorriarán, Oscar Rodriguez and Javier Garcia de Paredes) and against one of its co-chairs, Julio Fernandez Gayoso, for alleged deseal administration or alternatively of an offense of misappropriation.
The order finds that they all acted "with abuse of his official duties and with full knowledge of the very difficult economic situation that crossed the lender", operated by the Bank of Spain in September 2011. The prosecution claim them back at least 7.8 million euros. Judge allows Corruption allegations that all "goods fraudulently arranged the body, hiding the board of directors and the Bank of Spain the amount of their early retirement, and which in part had no right, all to the detriment of the lender who administered the Fund and Bank Restructuring (FROB). The state owns 90% of an entity after injecting 1.162 billion euros in 2010 and another 2.465 million euros in 2011, through the FROB. In this framework, the five defendants agreed to modify their contracts of senior management to introduce new early retirement payments and future benefits, before the intervention of the Bank of Spain, and then presenting their benefit resign.
