Lawsuits against Spain for pay cuts to renewables accumulate. So far, most arbitration claims have been raised by large international firms that had made direct investments , especially Spanish photovoltaic and solar thermal plants. Now, foreign associations are minority shareholders of large Spanish companies that have decided to raise an arbitration against Spain , according to people familiar with the decision.
This is a novel approach . The decision was made last week in Madrid for the assembly of these associations , grouped EuroFinUse , the European Federation of Financial Services Users . Law firm Cremades & Calvo Sotelo has issued an opinion to the association in relation to the possibility of arbitration , especially in the case of wind power cuts that have hurt companies like Iberdrola and Acciona .
Spain has become the country with more claims for violation of the Energy Charter
The idea is to present an ad hoc arbitration governed by the rules of UNCITRAL ( United Nations Commission for arbitration ) . The opinion of Cremades & Calvo Sotelo admits that the approach is not usual in this type of investment disputes , as are investors and shareholders who have the legal standing to bring an arbitration investment protection . However , associations of small shareholders are determined to go ahead with your claim and believe it may be a case in which a novel interpretation of the capacity to litigate in this way is made. "It's a border case ," say sources linked to EuroFinUse . " If accepted , you can set an important precedent," he added . Legal sources admit the difficulty of the process go forward.
AEMEC , the Spanish association member of the European Federation would not be standing to seek arbitration to be Spanish . It would EuroFinUse and other foreign associations which should give step . The claim would be hundreds of million to reimburse the affected firms that are minority shareholders.

Spain has become the country with more claims for violation of the Energy Charter as a result of cuts in pay for renewable energy . Big investment funds, financial firms and private and public companies of foreign nationality cases raised in different organisms .
The company 's exposure to Iberdrola 's wind segment , with a share of 24.2 %, followed by Acciona, with 18.6 %, EDPR , with 9.2 % , and Enel, with 6.2 %. It was precisely the president of Iberdrola, Ignacio Sánchez Galán who announced in London last week which slowed investment company in Spain in response to the impact of energy reform on the outcome of electricity . Something like , without bells and whistles , passes Acciona. The company headed by José Manuel Entrecanales says it is carrying out a plan of "war economy " going to suspend the distribution of dividends to shareholders , issuing debt to cover its liquidity needs , the cessation of major projects investment and research and sale of certain assets of the family group to address the situation, as you must maintain a significant cash flow to meet the annual debt payment .
The cut premiums for renewable energy that includes the recent energy reform and , in particular , the cut on the wind sector absorbs more than 60% of the total, will jeopardize the results of Acciona. Analysts estimate that the impact of legislative changes to the company between 200 and 250 million per year, which would add 170 million annually from previous measures began to take effect in 2013. In total, some 400 million subtracted from the income statement for a company that earned 189.4 million in 2012 . If those numbers are confirmed, the company would take losses. Acciona present results on Thursday .
