Pescanova War
The Galician company crisis requires new management negotiates with creditors

Since March 1 preconcurso submit your request by creditors, the situation of the company Pescanova, chaired by Manuel Fernández de Sousa, has gone from bad to worse. The crisis of the company, with more than 10,000 workers, has exploded by the assumption that there is double counting, the real debt is much higher (at least in some 1,200 million euros) to the officially admitted that those responsible for Pescanova have hidden to shareholders and investors relevant information on accounts, to the point that remains to be formulated after a council of almost 13 hours in contravention of the express order of the National Securities Market Commission (CNMV). In this chaotic situation has joined more than a factor of disorder: the company has fired its auditor, BDO, after mutual reproaches, and seems willing to hire a forensic auditor to examine the likely accounting fraud.
The above facts are sufficient to conclude that the management of the multinational, starting with the president, should leave office immediately, because the alleged debt concealment and breach of commitments to investors and the CNMV are your sole responsibility. Fighting in the advice and conflict with the auditor reinforce this urgency. A new direction must negotiate with the bankruptcy banks (as requested) and any delay in appointing a new responsible only reduce the chances of saving the company on the stock exchange suspended to avoid total collapse. There are few precedents that a company is unable to formulate their accounts and thus reassure creditors and investors. It is an anomaly that can only be explained by the resistance of the president to leave office, perhaps to protect against any legal action that shareholders can take against him.
The Pescanova case further illustrates the difficulties that have Spanish corporate shareholders to monitor the action of bodies. There is also no clear-cut corporate rules that can arbitrate disputes within councils and audit functions are not sufficient to ensure the accuracy of the accounts. The result is that the financial regulator, the CNMV, is a spectator of the crisis.
