The Social Chamber of the National Court has endorsed the Redundancy Employment (ERE) of NCG Banco, formerly Novacaixagalicia, which involves the removal of 1,850 jobs, as a measure to ensure that the company could continue operating.
The ruling, appealed to the Supreme Court rejects the resources of several unions alleging that there had been no real negotiation process and states that the consultation period allowed lowering initial dismissal of 2,508 proposed by the company at 2250, but eventually were 1,850.
According to the judges, the measures implemented by NCG are justified given the critical situation in which he was and understand that, if not already taken would have meant its closure.
"Even when outstanding measures agreed in the previous collective dismissal, the entity had entered a spiral of mounting losses and also had to meet certain conditions in order to get public funding without which it could continue to operate," says the room.
It therefore considers that "the situation amply justified the implementation of a new process of collective dismissal."
Specifically, the results before tax were Banco NCG 2011 EUR -121.7 million and 1229.9 million in June 2012, and the expected losses for last September were nearly 7.966 million.
This situation is also credited with the gross return of the bank, which had increased from 7.3 percent in 2010, to -863 percent estimated for 2012.
Thus, according to the resolution, "it is impossible to deny the existence of a negative economic situation and provided supporting contractual extinctions since the entity and the group that is integrated, has suffered huge losses and growing enormously in both recent years. "
So much so, he continues, that "not having received state aid resulting from the Restructuring Plan, which requires, logically fulfilling its conditions, including those relating to contractual-extinctions, the bank would not have been able to continue operating."
To this add that upon receipt of "significant" aid, 9,000 million euros, the company is now in a more healthy.
"That was precisely the goal, whose achievement at all belie the economic difficulties that led to this whole process," concluded the judges.
