It has been two and a half months since the judgment of the Court of Justice of the European Union considered unfair Spanish mortgage system. Meanwhile, the Spanish government has approved a new law (the 1/2013) which ignores the approaches of the ILP for-payment in which collected a million and a half signatures-and the Platform of People Affected by Mortgages (PAH ) branded as "useless, illegal and violates human rights." Particularly serious believes that the new law only allows one month deadline for claiming unfair affected. With these raw, the legal team of the PAH has just launched a "emergency kit" for families who can not pay the mortgage and have ongoing implementation processes. That is, the most urgent cases, those who are threatened with eviction.
This packet includes general advice for these families to claim unfair terms in their mortgage contract before 16 June, the month that the new law gives to allege; model writing to request legal aid, to raise unfair and also to seek a stay of attorney auction (if the process is court).
The main criticisms of the platform antidesahucios the new law are that it provides "no option" for people who have lost housing "condemning them to social exclusion" and that fixed things for procedures only month to plead unfair terms, which considers "legal uncertainty". In addition, the new law still allows forced evictions and "without alternative housing" and "maintains perpetual debt." Although the new law "formally introduces the possibility of retroactivity, the conditions required to implement it prevents."

The platform further recalls that, while evictions are occurring in Spain there are three million empty homes, according to INE data, many of them from families precisely embargoes or promoters.
