Meeting of creditors continue to escalate and beat record after record. Last year, 7,799 companies applied for insolvency proceedings opened, 32% more than in 2011, according to bankruptcy statistics National Statistics Institute (INE) published on Wednesday. If that figure we add the 927 individuals who sought judicial protection during exercise (2.7% less than in 2011), the total debtors amounted to 8,726, up 27.1%.
The sector where more contests was, once again, the construction (with 2,350 procedures, up 22.8%), followed by trade and very closely by the industry (1,447 and 1,444 competitions, respectively). However, if you divide the number of insolvent companies by total societies, the most affected is the industry and energy (0.61% of all companies), followed by construction (0.43% ) and trade (0.17%). Since 2008, the percentage of contests in the industry has always exceeded the brick sector.
The rise in the number of contests led the previous Socialist government to reform the Bankruptcy Act 2003 to facilitate access to the shortened procedure. The reform, which took effect on January 1, seems to have had the opposite effect than expected: while the number of abbreviated procedures has grown a meager 9%, the regular contests has more than tripled (up 237%) , after falling 7% in 2011. The vast majority of the contests (94%) volunteered, ie requested by the companies themselves.
Most companies that requested court protection last year (23.8%) were over 20 years old. Contests affecting older firms especially in industry occurred: 45.8% of industrial enterprises that were presented before the court were 20 years or older. Older firms are also more employees are: almost half (49.5%) of companies with over 50 employees who filed bankruptcy were more than 20 years.
In absolute terms, the community where there were more contests was Catalonia, with 1,879 procedures, followed by Valencia (with 1,355) and Madrid (1077). These three communities account for nearly half (49.4%) of all proceedings. With respect to all companies, Valencia and the Basque country in the HDI, with 29 bankrupt companies per 10,000, followed by Catalonia, Balearic Islands and La Rioja, with 23.
