The company claims to Novagalicia Bank Aviva (NCG) by unilaterally breaking 430 million agreement signed in 2001 with Caixa Galicia, one of the boxes built into the nationalized entity, to sell insurance and pension plans in their bank branches. As stated in the annual report submitted to the CNMV NCG, the entity has not made any provision to meet the payment of this amount, of which 56 million are in compensation. If Aviva claim finally goes ahead, the insurance compensation will further complicate the already difficult situation of the nationalized Novagalicia, which closed 2012 with a loss of 7,937 million euros.
Aviva and Caixa Galicia signed a partnership in July 2001 for the development, marketing and distribution of personal insurance bank and pension through the branch network. The operation was carried through the Aviva acquisition of 50% stake in Aviva CXG society.
However, the alliance broke down after the subscription by the FROB's 93.16% stake in the bank without prior written consent from Aviva. Also, according to the insurer understood by the banking network integration Caixa Galicia and Caixanova NCG Banco, affecting "the exclusive right to market their products," it added.
After the breakdown of the alliance, Aviva asked the October 3, 2012 an arbitration before the Court of Arbitration of the Chamber of Commerce and Industry of Madrid claiming the breach of the agreements.
Aviva had a similar dispute with Bankia, another nationalized entities. In that case, the conflict ended with the payment of 608 million to the insurer from the group chaired by Mr. Goirigolzarri.

Moreover, the report submitted to the CNMV also collects the sharp drop in deposits suffered by the entity following its nationalization, which caused some doubts about the solvency of the group formed from the merger of the old Galician boxes. Thus, the savings wagered by customers fell 17% over 2012, to 38.424 million, representing a reduction of 7.900 million. Taking into account the valuation adjustments, the final figure is reduced to 38.808 million.
The reduction is explained by the reduction in time deposits suffered in 2012, which corresponds with the shells themselves, which fell from 29,000 million 2011-21100 million euros at the end of December 2012. In current accounts had about 4,000 billion, and savings accounts, more than 8,000 million. In the same period, the liability in all Spanish institutions remained unchanged, according to the Bank of Spain.
The remaining 5,000 million, to exceed 38,000 million, are due to the repos. Also, the controversial preference shares, subordinated debt and other hybrids, the balance came down from 1.460 million 2011-670000000.
