The ruling coalition Ireland reached Tuesday night an agreement to amend the restrictive abortion laws that allow abortion for women at risk of death if it interrupt the pregnancy, including those with a clear risk of suicide. Although the law already provided since 1983 the right to life of the mother at the same level as that of the unborn, and since 1992 included the suicide risk factors threatening, did generically and in practice rarely Once abortions performed. Between 4,000 and 7,000 women travel each year to the neighboring United Kingdom to abort.
Pro-abortion groups have denounced the proposals approved by the government just going to change that situation, but anti-abortion groups argue that the new legislation will open the door to abortion, particularly by including suicide risk factor. The proposal approved by the coalition of the nationalist conservative Fine Gael and the Labour Party, which has to be approved by both houses of Parliament, is, however, clearly restrictive in that regard. A panel of three doctors (an obstetrician and two psychiatrists) must certify unanimously that there really is a risk of suicide. If you deny the right of women to terminate their pregnancy, this may refer to a second panel of three physicians.
However, these requirements are less restrictive than those shuffled in a previous project, which envisaged that the panel be composed of six physicians. It has also ruled that the requirement that panel necessarily appear perinatal psychiatrist, described as "idiot" by one of the only three perinatal psychiatrists are in Ireland.
The inclusion of the risk of suicide in legislation pending clarification since 1992 the Supreme Court ruled that judges had to have prevented a young traveling abroad for an abortion on the grounds that the risk of suicide if it was aborted a threat to his life.
Clarifications on when you can abort because the mother is in danger of death are the result of a judgment of the Court of Strasbourg, 2010. Although the Government was preparing these clarifications, death in December 2012 of Savita Halappanavar after the doctors refused the abortion insistently claiming to have added urgency to these clarifications.
The proposal agreed by the coalition authorizes a physician to terminate a pregnancy if an emergency situation concluded that the woman is in danger. If the case is not urgent, the decision must be taken by two doctors.
The proposed law does not require doctors, nurses or midwives to practice or participate in performing an abortion, however, warns that "any institution, organization or third party may refuse to provide a legal termination of pregnancy for reasons of conscientious objection ".
