Although it is late and in response to social pressure, institutions begin to make a move to protect the citizens of the current mortgage legislation. The Catalan government yesterday approved the bill to amend the Law on Consumer Code of Catalonia in order to increase transparency in hiring credits or loans and to cap the performance of banks.
One of the main features is that it sets a maximum interest shall not exceed 2.5 times the legal interest, so any mortgage clause that includes a higher percentage is unfair. That means the non-payments will not be penalized with more than 10%. Currently, some financial institutions apply a surcharge that goes to 30%. The PP government announced in December its intention to set this cap at 12% interest. The change will not be retroactive to the difficulties involved in this current mortgage law.
Another change will affect advertising communications received the citizen. The Government proposes that these documents are clear, objective and not misleading. "That does not generate false expectations to consumers," says the Catalan government. And this requires that state clearly that charged fees and expenses that will be generated, which until now did not exist.
Are obvious, but the vast majority of citizens signed their mortgage without having clear consequences for non-payment. Now the law require that consumers be warned about the possibility of increasing the interest rate, the risk of losing the property if not paid fees and clauses that pose the greatest risk.
"It can not happen again that people of good faith contracted products and then run out the fine print in a dead end and a pitiful situation," said yesterday the Minister of the Presidency, Francesc Homs, just after the weekly meeting Catalan Government.
Consumers can also choose the notary who intervene in the operation and provide an appraisal of the property, which must be accepted by the bank, now who does it.
It also reinforces the obligation of notaries to inform consumers of everything that involves the loan being signed and having the deed of contract with a minimum of three days for signature. The project promotes mediation and arbitration to resolve disputes, with particular emphasis on those related to foreclosure cases of the residence.

Change Convergence and Union address and the Catalan government regarding the scandal of the preference shares. The left CiU Executive abundantly clear last summer that was not the work of a sale of preference by the Catalan savings banks were investigated in the Parliament. The government said the commission of inquiry into the boxes should be limited to research institutions that received public money. Eight months later and with the unrest in the preferred maximum levels by the Catalan Government yesterday showed very different discourse.
The Minister of the Presidency, Francesc Homs said that in some cases the problem of preference "is poignant because it directly has deceived people", and argued that CiU bet now because representatives of all entities that marketed these products to be brought to Parliament commission independent research.
"It's more important than ever to provide explanations," defended the counselor, who argued that it had the same performance in this case the entities audited by the State that the other banks and thrifts. The CiU government argues that its position change also reflects the change that has taken place in society over recent months, with increased concern for the banking scandals.
