The hydrocarbon prices in Spain before taxes-are of the highest in Europe. The National Competition Commission (CNC) has studied the reasons for this and has concluded that the lack of competition, strong corporate concentration and difficulty in accessing the markets are to blame. The supervisor described, in a strong statement, a scenario with multiple barriers to competition, believes there are barriers to entry in retail (at the pump) and formidable obstacles in the wholesale sector (refineries).
The report shows "insufficient effective competition in the sector of automotive fuels in Spain, and this could explain the high level of prices and margins registered in Spain and its differential with respect to other EU countries."

Competition notes that the sector distribution of motor fuels is highly concentrated around three main operators (Repsol, Cepsa and BP), which "enjoy substantial advantages compared to other operators." This business concentration is higher than in comparable European countries, according to the report.
At the time, the CNC notes that since the economic crisis began in 2007, until 2010 gross margin distribution-the part of the price attributable to the structure of production and trade, has grown 20% in both gasoline and in diesel. The agency states that this increase occurs even though it was based on initial levels higher than in neighboring countries. He adds: "Despite the sharp contraction in demand for fuels experienced since."
Competition, which released the report Monday on motor fuels market in Spain, prepared at the request of the Secretary of State for Economic Affairs, noted that "operators with refining capacity have significant power in the supply of fuel, in the wholesale distribution and retail via the gas stations. " This means that the oil majors control the market.
The body alert the lack of control and regulation on CLH, which holds the main reception facilities, transportation and storage of fuels. This situation worsens, says competition because the majors have access and influence over this company.

The National Competition Commission (CNC) and the National Energy Commission (CNE) today called on the Government to prohibit incumbents recommend prices to its distributors in order to promote competition and cheaper fuels.
As an indicator of the pact between the great prices, the report reveals that the CNE independent gas stations selling fuel, on average, between 1.4 and 1.7 cents cheaper, suggesting that participating operators' of directly on the determination of the final prices in the retail outlets of its distribution network. "
The 85-page document notes that there are numerous administrative obstacles to open new service stations in Spain. Attributed to this obstacle administrative councils. It also underlines the difficulty to implement new refineries and remember that the last one was built in Spain in 1970.
After consideration the sector, the Government proposes Competition 23 specific measures to strengthen competition and facilitate the entry of other operators in the fuel market. "These measures must be necessary and simultaneously in both market segments (wholesale and retail)." Among the proposals made by the Government Competencies are measures to facilitate the opening of new service stations, streamlining the procedures for the construction of new refineries, reduce the duration of exclusive supply contracts, limiting sales of previous recommendations to public and improve transparency.
Moreover, the National Energy Commission, also published on Monday a report on the sector, claimed easy installation of new service stations in hypermarkets, malls and highways, to improve competition and lower prices thus gasoline and diesel fuels.
