The uproar surrounding the granting of asylum by Ecuador to Wikileaks founder Julian Assange, hides the essential underlying inconsistencies. Only by examining them understand what is really at stake.
For starters, Ecuador, whose policy in general liberties and press freedom in particular, is anything but open, flies the flag of the state of law and respect for freedom of expression, while casting doubt on Sweden, a leading country in due process and international law.
This incongruity is completed by Baltasar Garzon, who owes its international renown to the successful request for the extradition of Augusto Pinochet, based on a strict interpretation of political asylum, now, at the head of the legal team of Assange, defends a radically different position.
The rejection of the extradition of Assange to Sweden for questioning over allegations of sexual assault, is based on the alleged interference in the case by the United States, notwithstanding that it has not materialized in some form or fashion. So while Ecuador flag flies of British colonialism, the essential is that both Assange and Garzon as President Rafael Correa of Ecuador are using the old familiar slogan of "blame America" to evade arrest warrant issued with full European procedural safeguards against the first, and signed by the UK Supreme Court.
The significance of this case lies beyond the specific data it up, in the rise of a kind of populism that is wrapped in the rule of law while invariably undermines its scope and respect. Unfortunately, the caricature of the rule of law concocted by Assange, Correa and other populists gaining adherents in large segments of the public opinions of the globalized world of today. And the danger is inconsistent and selective application of principles and legal or quasi legal precepts that is the hallmark of the phenomenon that we face, and his radical incompatibility with predictability and generality that underpins the rule of law. By distorting reality and distorted presentation of the Swedish legal system, recognized bearer of legal certainty and fairness, and professionalism, the champions of this subversion undermine the foundation of an international system that acts as a barrier against totalitarian impulses .
Notwithstanding the above, the most striking aspect of the Assange case resides in thunderous silence of those actors and institutions whose existence and legitimacy derives from the integrity of the concept of rule of law. Starting with the European Union, whose silence can not be more revealing. The official website of the European External Action Service collects an overabundance of pronouncements and convictions of issues ranging from Syria to Madagascar through Texas, but a search for the word "Assange" shows a single entry April 2012 on the reaction Hassan Nasrallah to Wikileaks.
No one, not the often lengthy European Commission President Jose Manuel Barroso, the ever elusive and Council President Hermann von Rompoy nor cautious High Representative of the Union for Foreign Affairs and Security Policy, Catherine Ashton, have considered worthwhile to step out of unfounded criticism leveled against two of its member states, and defend crucial touted as an instrument of the Union-the European Arrest Warrant-origin Assange's arrest by the UK authorities.
How does the European Union, criticadísima by their proclivity to make declarations and manifestations, is silent on this issue, in which his voice not only makes sense, but could also have an influence? It is therefore time for the European leadership voices rise up loud and clear, bookmarking that, we hope, will inspire other leaders and international organizations.
