The war between airlines and AENA by higher fees charged by airports in Spain has come to Brussels. The European Commission has opened an investigation to determine the legality of the increases that took effect in July 2012 and in the case of Madrid-Barajas and Barcelona-El Prat reached 50%. The Government has two months to submit information justifying the increases, as required to Brussels.
The requirement of Brussels, the first step of an infringement procedure, comes in the wake of several complaints by airlines and travel agencies that have been wronged by AENA's decision, announced in June. The companies claim that they were not consulted before the changes, as required by the directive on airport charges, adopted in 2009. In a statement released Wednesday, the Committee reminds the Government also sets the rules "minimum requirements for calculating rates," and requests information justifying the raise.
A spokeswoman pointed from Brussels that AENA must provide data showing that the new rates will be a real increase in the cost of managing their airports, for example, for new investments. If the information does not meet the Commission will urge the Government to make the necessary changes, otherwise the case may end up in court.
Brussels warns also of the potential impact of the increased activity of the affected airports. "The rate increase is significant for airlines, as a result of which companies may be deterred from operating at both airports," said in a statement in connection with Barajas and El Prat.

Actually, there have been consequences. In June, shortly after the adoption of the rate hike for 2012, the budget airline Easyjet announced he was leaving his home base in Madrid by the high rates and oversupply of cheap. The airline will operate flights to Barajas, but its aircraft and personnel allocated to other airports outside of Spain from next winter 2012-2013.
