No agreement with the PSOE and without changing the law or the Mortgage or Civil Procedure, which govern the process of eviction. The Government today approved in the Council of Ministers decree law with measures to mitigate the effects of the evictions. It is "urgent" measures that may be extended by the Executive in the parliamentary procedure of the standard. These are the keys of the decree:
■ Do not touch the law. The measures do not involve any change in the laws governing foreclosures today, the judges considered "unfair" for debtors. What makes this decree is to establish a moratorium on the ultimate effect of these laws (the eviction of families from their homes), for a period of two years, for the most vulnerable families.■ two-year moratorium for the most vulnerable. Families who do not enter among all members of 1,597 euros per month (3 times the minimum wage, public income indicator of multiple effects, which in 2012 is 532 euros per month, which is 19,200 euros per year counted twelve pay), when the house is going to evict her only home ownership, when their mortgage burden has increased at least by 1.5% in the last four years, and when they had to pay a mortgage of more than 50% of its net income will not be evicted for two years if they meet any of the well following requirements:■ be a large family,■ lone parent with two dependent children,■ family with less than three years,■ families who has the care of people at more than 33% disability or dependency permanently unfit for work activity,■ families living with relatives (up to third degree of consanguinity or affinity) who are disabled, dependent or suffering a serious illness that incapacitates them temporarily or permanently to a work activity,■ families in which debtors are unemployed and have exhausted the supply,■ victims of gender violence.
■ Park rental housing for evicted. The government creates "a park for rental housing", yielding "low and reasonable" for people who have been left homeless, as announced by the Deputy Prime Minister, Soraya Saenz de Santamaria. The government has not said who will benefit from these stories, or when or how many homes will be available. This park will draw, as explained by the Minister of Economy, Luis de Guindos, with houses allocated by default to the entities, "including FROB (bank restructuring fund)."■ There are retroactive measures. That is, those who have already lost their homes, even if they meet the above requirements, not recovered. What I could do, as explained by the government's number two, is eligible for a low rental housing.■ No payment in kind. "The debt and interest must return" has ruled the economy minister, Luis de Guindos, in the appearance after the Council of Ministers. That is the philosophy of the measures adopted, hence the government did not include the possibility that widespread delivery of the house is paid off debt, as demanded by the affected groups.■ Do not touch the default interest. Nor is set a ceiling for these interests begin to increase debt when families fail to pay the mortgage payment. The PSOE wanted could not be higher by more than two points remunerative interests (than usual now that are ten points higher). The Government has said that in the parliamentary proceedings of the standard may be improvements in this regard.■ Do not touch the appraised value. It was one of the hot spots of the law denounced judges and other groups in the law that the PSOE wanted change. Socialists proposed that the appraisal value auction purposes could not be less than the appraised value on which the loan was granted. As with default interest, the executive says that in the process may be addressed in Parliament changes, also "mechanisms to give greater independence to appraisal companies compared to banks when pricing the house."
The government has also advanced to modify the thresholds for the application of the Code of Practice of Government (voluntary for institutions, not with force of law).
