The Minister of Justice, Alberto Ruiz-Gallardón, has announced this morning in Congress that all victims of male violence or child abuse, terrorism and the trafficking of women (prostitution) shall be entitled to legal aid regardless of their income level. That means they are exempt from all legal costs (fees, attorney and solicitor), but only for those lawsuits that have to do with their status as victims. For example, a victim of terrorism will be free to demand justice at State unpaid compensation, or a battered woman may divorce free, but use a traffic ticket or sue a neighbor or report a theft will continue to cost the same as the rest of citizens (unless, income level, and if they had the right to legal aid for that too).
Initially, Justice also included in this group of new beneficiaries to the physically and mentally disabled. In fact, according to the ministry later clarified, will be only the latter, and only in the case of sexual abuse or maltreatment, which have access to legal aid.
With this announcement, the Minister of Justice has tried to give a bombshell on his response to a question from the Socialist deputy, Carmen Stack, who had complained that victims of violence are required to pay court fees in the new procedures civilians (eg, divorce her abuser), because the PP has voted against exempted from this payment. "This law is macho and machismo kills," said the parliamentarian. Gallardón has argued in its response that, although women victims of sexual violence do not pay taxes, continue to pay attorney and solicitor. "Your request is insufficient and unsupportive", has criticized Heap. Minutes later, legal reform has announced that not only relieve the women of rates, but also a barrister and solicitor in these and other cases of divorce. That is when the Legal Aid Act is approved, probably next month.

Gallardón, however, ignored his party, the PP, was rejected yesterday battered exempt from payment of fees, and neither he nor the ministry who heads spoke of this novelty announced today as the Fees Act came into force last week and the controversy erupted. The Observatory of Gender Violence and associations fighting against gender violence had warned that, although the complaint for abuse not pay taxes (because all the criminal jurisdiction is exempt), rates in the civil courts could deter many women divorced or claim a pension, especially when many of them economically dependent on their abuser. Justice then said he thought not exempt victims of male violence in these rates. Just played down the criticism. Despite all this, today Gallardón presented as a legislative reform initiative and the ministry denies that it is a correction.
The right to legal aid for victims of abuse, terrorism and mental disabilities who have experienced violence is also something that Justice had to include in the legislation because it requires a recent European directive. Although the obligation was only to criminal proceedings, and the ministry will also extend to civil, administrative litigation and social (labor), as explained a spokeswoman for the department, reports Fernando Garea.
Justice has not clarified whether, after benefiting from legal aid, beneficiaries would have to accept a lawyer, resigning himself to hire one, or could benefit half: escape rates without necessarily having to take counsel counsel. That being studied because the Legal Aid Act (which include the measure announced today by Gallardón) is still closed.
