The State Council considers levy a euro each prescription from doctors in public health may contravene the Constitution. This tax violates the exclusive jurisdiction of the state on the bases and general coordination of health. Specifically, with regard to issues relating to health provision, and that the regions can not influence "either directly or indirectly in the pricing of medicines," according to an opinion that responds to a query from the Ministry of Finance and Public Administration to certain provisions of the budget stability law that approved the Catalan parliament in March 2012, among which is the euro per prescription.
In addition to Article 149.1.16, which alludes to the great competition on sanitary lines, the opinion of the advisory body referred to another conflict, related to another subparagraph of Article, 149.1.1: inequality can assume that the tax on access to medicines. "This certainly can come inequality caused by the requirement of a fee (...) to force citizens to purchase drugs in their territory to make a payment to be greater than the face in other parts of the territory of the State" , in the report.
The opinion, which refers to the action taken by the Catalan government in July and plans to implement the Madrid since January, highlights that does not call into question the ability of the Government to set its own taxes. The decision of the Council of State has had three separate opinions to consider that there are sufficient grounds to consider unconstitutional euro rate prescription.
The rate to drugs is a controversial initiative criticized not only by opposition parties in Catalonia and Madrid. The Prime Minister, Mariano Rajoy, has also clearly voiced opposition to the measure. "I do not like the euro prescription," said ten days ago in a radio interview. Announcing the Executive Vice President, Soraya Sáenz de Santamaría, the PP was considering recourse to the Constitutional Court, the President of the Executive said in the same interview his intention to negotiate with the euro Catalonia and Madrid prescription.
