A new ruling vindicates the unions on the withdrawal of the December extra pay public employees, understanding that can not be applied retroactively cuts. Several courts have ruled in favor of the unions in this matter and has even raised a question of constitutionality to the Constitutional Court by the elimination of the pay, which the high court has admitted.
The Chamber of the Superior Court of Justice of Madrid (TSJM) in a judgment dated April and against which there is an appeal to the Supreme Court, believes that more than 32,000 staff workers who are working in the Community (the officials have to rely on the contentious-administrative) are entitled to the portion of the bonus earned between January 1 and July 14, 2012, as the royal decree retired pay them entered into force December 15 July.
In the same line TSJM other similar statements are rejected union arguments regarding the right to collective bargaining and collective agreements prevalence but recognizes the right to collect accrued as non-retroactivity of laws.
According to the sector secretary CCOO Autonomous Administration of Madrid, Javier Diaz Toril, that means an average of 900 euros for each of the more than 32,000 people who have the status of staff working in the Community, about 28, 8 million euros in total. To turn, the regional government should disclose that money or bank guarantees that amount.
