The plenum of the Parliament has unanimously approved this morning a bill to allow payment in families who can not meet the payment of a mortgage, so that the delivery of housing pay off the debt with the bank. The proposal was sent to the House of Representatives for its passage because it would be necessary to amend several articles of the Civil Procedure Act and the repeal of a section of the Mortgage Law.
The bill passed by the Parliament comes after more than a year of committee work, corresponding to two initiatives by ERC, ICV and Ciutadans which were processed separately, but eventually were integrated into one. Finally, all groups have reached an agreement to withdraw its amendments and the proposal has obtained 128 votes in favor.
Between 2008 and 2011 have occurred in Spain over 166,000 foreclosure proceedings, 20,000 of them in Barcelona. Only last year were carried out in Catalonia over 11,000 such processes, which in 82% of cases involving families where there are minors. Hence the need for decisive action to confront a reality that affects every day more people, both highlighted by all speakers of parliament, though with different discourses.
Representatives of the Platform of People Affected by Mortgage have come this morning to continue the discussion of a proposition in court procedures which provide, among which include the payment in kind, but also other measures to ensure retention in housing. In countries like France and Belgium, the delivery of housing satisfy the debt with the bank and the debtor is not pursued after the delivery as it is now in Spain.
The bill sets out measures to resolve the indebtedness associated with the acquisition of residence and correct the current legal vacuum. Thus, for example, is limited to 30 years to grant a mortgage loan and prohibits financial institutions to grant mortgages for an amount greater than 90% of property valuation. Another chapter of the proposal covers some of the procedure for foreclosure in public housing.
In the final provisions of the Bill specifies the tax treatment must have the payment in kind so as not to aggravate the economic situation of debtors and calls upon the Government and other institutions to ensure transparency and equity of assessments independence from the companies that make them.
