German Finance Minister, Christian Democrat Wolfgang Schäuble (CDU), has urged the Constitutional Court to move swiftly to approve German participation in the permanent fund ESM stability. It was during the minister's appearance at the hearing constitutionality of the process of German law governing such participation, approved last June 29 by both Houses of Parliament. The Federal President not to ratify the Constitutional rule on emergency resources brought against her.
Schäuble warned the Court that any "considerable delay" in the functioning of European ESM background cause "a significant nervousness in the markets' financial statements. This nervousness would undermine" the confidence in the euro, "he added. The complainants request precautionary cessation of both laws until the German TC definitive ruling on the merits, which could take months. So the first decision of the judges in Karlsruhe is whether they will allow the laws to be ratified before the final judgment, while studying the appeals against the ESM and the fiscal pact. The President of the Constitutional Voßkuhle Andreas, insisted on Tuesday that now is not dispositive regarding the legality or illegality of the recently enacted legislation, but the legal necessity of paralyzing until they reach a firm verdict.
A decision is expected in the coming weeks, but the judge warned Voßkeule that the process could be delayed longer than expected: "The rules we have set ourselves also have to rule in situations where it does not seem politically expedient." At first sight, asked the experts and politicians involved to "always maintain objectivity."
Several organizations, including the parliamentary group Left (Die Linke), have come before the high court because they believe that the laws passed by Parliament in June violate the German Basic Law and undertake the necessary public funds without parliamentary oversight.
As a result of numerous complaints, the Constitutional Court requested the President of Germany, Joachim Gauck, not to ratify the law until it is established that compliance with the Constitution. While it is an extraordinary measure, not the first time a president postponed the ratification of a law already approved by Parliament until the TC checks its legal validity. Caution is greater in international conventions, because once ratified, the law will be binding to Germany's European partners.
European leaders wanted the ESM came into force this month, but these legal problems in Germany and delayed its approval in Italy it will be impossible. The Spanish bank bailout will therefore provisional EFSF fund, which has been running since 2010. Once approved the ESM, the provision for Spanish banks will save this new institution, which also will be based in Luxembourg.
The German Constitutional Court has been closely monitoring policy decisions since the crisis began the euro for two years. The judges of Karlsruhe, dressed in scarlet robes of the cap and adorned with frilly white, is one of the most attractive recurring appointments of this tangled debt crisis.
