Amina Filali, Moroccan 16, killed himself with rat poison in March last year after being forced by her family to marry the man who raped her a few months before, which saved the offender to go to prison. The case raised a controversy in the country, to the point that now the government will cancel the rule that allows a child rapist to escape punishment if he admits to marry her, as long as there is a complaint by the family of the victim.
The Moroccan Justice Ministry said Monday in a statement to support a bill under which cancels the second paragraph of Article 475 of the Penal Code, which allows violations wash with marriage. The new regulations also introduce several amendments to toughen sanctions against those "seduce" or sexually assault a minor, which could be up to 30 years in prison. The proposal has already been approved by the Law and Justice Committee of the House of Councillors (upper house) and must now pass the procedure of voting in plenary and in the same Chamber of Representatives (lower house), which is given for granted.
The drama of Amina Filali also highlighted the need to combat gender-based violence and early marriage, which remain sensitive legal issues in the country.
The Family Code allows child marriage in Articles 20 and 21, but sees it as an "exception" that has to be preceded by a reasoned decision of the competent court a medical certificate and a social worker. However, these conditions often go overlooked and early marriage remains an "ordinary practice" especially in rural areas.
The current Moroccan government led by the Islamist Justice and Development Party (PJD), which controls the ministries of Justice and the Family, has had in recent months a speech ambiguous as early marriage, but has supported an upsurge penalties for child sexual assault. Under pressure from feminist groups and human rights, the party recently introduced in Parliament a bill to the Family Code prohibits marriage without modification of the under 16, but refused to be defined as "rape" all sex with minors.
The new measures have not been fully satisfied, the activists, who claim a revision of the Penal Code and the Family Code in its entirety. "It's a plus, but not enough," says Fauzia Asuli, president of the Federation of the Democratic League of the Rights of Women.
According to the latest statistics available from the Ministry of Social Development, Family and Solidarity, one in ten marriages in Morocco in 2010 was premature, often conceived as a solution to poverty or output to safeguard the honor of an abused woman.
