The Bank of Spain changes the supervision model
The Country Madrid 8 ENE 2013 - 23:25 CET
The Bank of Spain said on Tuesday the accusations made by the Inspectors Association of Credit Institutions in a paper delivered at the same supervisor and the contents reported by country. The Executive Committee yesterday studied the impact it has had dissemination of the contents of this document, prepared in connection with the preparation of a Commission report on Internal organization and procedures of bank supervision and adopted a statement of response to some of the statements conducted by the Association of Inspectors.
"The Executive Committee deeply regrets that the dissemination of any of the statements contained in that document, given its vagueness and nature, would compromise the supervisory task of the Bank of Spain, which has always been known for trying to meet the best international standards of rigor, independence and technical quality, in a particularly delicate moment in relation to the implementation of the single European supervision, "the statement said.
The most serious claim that document noted that "the normal way to react to evidence of crime is looking the other way." That's what has caused much more distress in the previous and the current team the Bank of Spain.
The statement from the Bank of Spain said that "any statements" Document of the Association of Inspectors "corresponds to possible irregularities concerning specific supervisory actions identified by the Association." He adds: "The Executive Committee wishes to reaffirm the constant practice of the inspection itself and the Bank of Spain in regard to full and complete cooperation with the courts and the prosecution regarding the prosecution of possible criminal conduct in the scope of its powers. "
Fernandez Ordonez breaks his silence
On the other hand, Miguel Fernández Ordóñez, former governor of the Bank of Spain has responded to the Inspectors Association in a letter to the editor of the country and thus breaks the silence maintained since leaving office in June. "The charge to the Bank of Spain is very serious, the commission of a crime, not to report the evidence to the Attorney-and goes beyond the unwarranted and unjustified smear campaign of the institution that was launched at the beginning of the month of May last year, in my opinion, to hide the consequences of an erroneous management Bankia crisis ".
Ordonez believes that the report which stated that "the usual reaction" supervisor "to signs of crime is looking the other way" is to question "not only the competence of employees and directors of the Bank of Spain but also its integrity. And so I break my silence with this card. During the nearly six years I have worked in the Bank as governor I have never seen that no employee or officer accused did what that headline. "
The arguments by Ordonez says it is not possible to conceal evidence of crimes are two. On the one hand, "the seriousness of the Legal Service of the Bank would not have tolerated anyone ever do anything against the law" and, on the other hand, "the Bank's work procedures prevent anyone from acting in the task of monitoring without a significant number of employees can find out and comment on any decision to make. "
Finally, claims indirectly inspectors if they have information about a case that has "looked the other way" with a hint of crime "den transfer to the prosecution who has to deal with it."
