The Constitutional Court (TC) has decided today to keep the precautionary suspension of payment of one euro for a prescription while ruling on the appeal filed against the government's decision to cash in the Community of Madrid. The TC admitted on 29 January processed the appeal, which involved the temporary suspension of the measure for four months. After that time, the court has decided to keep citing the "difficulty of repairing" that would exist if this region continue charging the rate and eventually be declared unconstitutional. The Administration, said the car "would be forced to arbitrate a refund procedure individualized management costs, even, could exceed the amount collected."
The TC has taken this decision after a couple of weeks ago chose to do the same with the euro Catalonia prescription, first community to adopt the measure in June last year. There are no "reasons to justify a different conclusion," argues the TC. The court has thus given by valid arguments made by the State Attorney to request the suspension of the fee in Madrid, introduced on January 1, considering that affects a situation covered by state law. In his view, the communities can not directly or indirectly affect the pricing of pharmaceuticals, according to the Constitution.

Furthermore, the State argues that, despite the reduced amount of the fee, "may emerge as barrier to access to pharmaceutical services for users with fewer resources and greater needs" because state adds to copayment. In this sense, the TC maintains that "general and public interest, related to the promotion and guarantee of the right to health, are interests associated with the defense of constitutional particularly sensitive goods". Similarly, considered "virtually impossible" possible return of the fees charged in the event that the measure be restored and finally declared unconstitutional.
In anticipation of this decision, the regional president, Ignacio Gonzalez, said yesterday that he will wait until the courts rule on the merits, which can take years, and it will not implement the measure even the TC lift the suspension, which no one expected him to do. Madrid withdrew therefore pulse that keeps the central Executive prescription euro bill, a controversial they have only launched Madrid and Catalonia against the judgment of the Government, which has appealed. Gonzalez says he will wait until the TC announce the decision or until the Ministry of Health to take a common measure to rationalize pharmaceutical spending.
Catalan pharmacies began to raise it on June 23, 2012. In just six months, the Government obtained 45.7 million and, according to his calculations, pharmaceutical spending fell by 5.9% due to the application of the levy. However, official data from the Ministry of Health showed that Catalonia fell less than other communities pharmaceutical spending despite the moderating effect of the euro course prescription. Madrid introduced the rate, despite knowing that the Central Government thought the Catalan resort. Was effective only 29 days and raised five million.
