The National Competition Commission (CNC) has claimed that the draft law on private security includes some "restrictions of competition", which act as barriers to entry to the sector. Despite assess "fair" most of the changes introduced by the new text requires justifying the persistence of restrictions.
Among the major flaws cited in the draft assessment report of the law to regulate sector activities are the existing activity booking for operators in the sector and subjecting companies to a system of prior authorization for the provision Most of the activities.

Similarly, states that also included "other administrative burdens" that, while not as damaging as the previous two, "involve alterations in the free provision of these services."
The NCC recognizes that it may be understood that these barriers are the result of "the desire to protect certain general interests" such as public safety or fundamental rights. Still reiterated the "need" to justify the restrictions.
Nevertheless, the Commission notes that many of the changes introduced by the new law must be accepted "fair" from the point of view of competition. For CNC, "good" examples of these improvements include the expansion of the access roads to the profession or the scope of activities that make up the core of the activities of private security.
In 2011, according to the latest data available, the industry turnover of 3,600 million euros and 1,500 companies employed nearly 90,000 people. However, with 200 private security guards per 100,000 inhabitants, in Spain there are 71 less than the European Union average.
