The PSOE this morning before the Board of Administrative Litigation of the National Court a document of 31 pages with their legal arguments to apply for suspension of the tax amnesty and the annulment of the rule governing it. Socialists believe that the rule would cause "irreparable harm to the Treasury".
Last July and appealed to the Constitutional considering that the measure approved by the PP government, which aims to bring out hidden money 2500 million. This allows fraudsters to regularize its position paying more than 10% of the money evaded. The Constitutional agreed to hear the appeal of the Socialists.
Now with the appeal before the Court as a precautionary measure intended to stop the measure. "The public interest present in our tax system requires a suspension of the contested provision, it is not possible to determine in the light of its wording that public interest may be harmed or above must prevail over", say the socialists in his exposition of reasons and added: "the adoption of the precautionary measure was not supposed to go to stop raising black money hidden, but it will be prosecuted with the instruments, effective, available to the Administration."
The appeal coincides with the debate on the entire bill to amend the budget and tax legislation and intensifying actions in preventing and combating fraud taking place this morning in Congress.
Treasury spokesman of the Socialist Group in Congress, Pedro Saura, believes that the Bill contains anti-fraud measures "positive", but actually "wash your face looking to the tax amnesty." Saura has insisted this morning that his group disagrees with "the story of the tax policy that makes the PP: raise taxes on the middle and lower classes and pass a tax amnesty for big returns."
So, socialists believe in the letter presented at the hearing that "the tax regularization extraordinary formula is frontally against the principles of equality, proportionality and progressivity that govern our tax system."
And justify the rule regulating the extraordinary tax regularization launched by the PP government is "no infringement of the principle of legality, to introduce innovations lacking substantive legal cover for the obvious overstepping legal empowerment and lack of normative range suitable for the regulation on ".
Finally, the PSOE argues that "it is certainly difficult, or impossible, to find a legal argument with constitutional anchor, that justifies the recognition of tax benefits fraudsters, following the now contested regulation, are relieved of compliance outstanding tax obligations and penalties that they may be entitled to payment of an amount. "
Socialist MP, Pedro Saura, adds that "tax evasion is the small electrician or plumber, where down is who has the money in tax havens." He concludes: "Tax havens are the cause of social hell because they help fund the welfare state."
