La experiencia de los doce países que la han regulado no es positiva. La ley debe proteger el 80% que son prostitutas forzosas

 La propuesta de legislar la prostitución aparece y desaparece cada cierto tiempo sin que nunca llegue a producirse un debate en profundidad sobre esta cuestión. Hace unos meses, la Organización de Inspectores de Hacienda del Estado planteaba regular la prostitución con el fin de "luchar contra sus efectos adversos y aumentar los ingresos públicos", ya que, si se legalizara la prostitución, se produciría un aumento considerable de cotizaciones a la Seguridad Social.
Hace unas semanas, un juez de Barcelona dictó una sentencia en la que condenaba el empresario de un prostíbulo a hacer contratos laborales a las mujeres que trabajaban en su local. Aducía que las mujeres que ejercen la prostitución libremente tienen derecho a una relación laboral normal. Al mismo tiempo, este diario informó de la reciente creación del primer lobby formado por varias asociaciones de prostitutas que reivindican sus derechos como "trabajadoras sexuales". La presidenta de este grupo se presentaba así: "Todas las mujeres que ejercemos sexo de pago lo hacemos libre y voluntariamente porque, si no, no es prostitución, es esclavitud".
El debate no es sencillo. Esgrimir el argumento de que la prostitución es la forma de explotación más antigua, que ha existido siempre y no dejará de existir, es el pretexto cómodo para no hacer nada y permanecer en la situación de alegalidad en la que nos encontramos. Una situación que ni protege jurídicamente las prostitutas ni consigue que la prostitución disminuya. Es el argumento derivado de la pereza de enfrentarse a una cuestión complicada.
Ante este razonamiento, los partidarios de legalizar la prostitución se unen en una defensa a ultranza de la libertad individual. En nombre de la libertad y en contra de un moralismo puritano, se pronuncian a favor de una aceptación abierta de la prostitución, que elimine la calle y el burdel. Ahora que las campañas electorales que se acercan alientan el apoyo a todas las causas susceptibles de ser rentables en votos, tanto la CUP como la plataforma Barcelona en Común han manifestado su apoyo a la propuesta de legalización de las trabajadoras sexuales.
La propuesta de regular la prostitución quiere justificarse en nombre de la libertad, y no discuto que haya algunas mujeres que ejercen la prostitución voluntariamente. Pero son una minoría insignificante. Los datos dicen que más del 80% de las prostitutas están ligadas a mafias que las traen de países de la Europa del Este y del Tercer Mundo. Hablar de libertad en estos casos es una broma. Prostituirse tiene un significado unívoco: es esclavizarse. No pongo en duda que haya mujeres que pueden permitirse el lujo de considerar que lo que hacen no es prostitución, sino un trabajo como cualquier otro. Pero la legislación no debe mirar a esta pequeña minoría de mujeres que se autodenominan libres, sino a la gran mayoría que no vacilaría en reconocer que vende su cuerpo porque es el más lucrativo que tiene a su alcance. La ley es, efectivamente, para todos, pero su objetivo primordial, en una sociedad que aspira a la justicia social, es proteger a los más desfavorecidos.

Si aparcamos los principios y nos fijamos en los resultados obtenidos allí donde la prostitución está legalizada, no encontramos datos muy convincentes para copiar las leyes. En Europa, la prostitución está legalizada en 12 países y, en ningún, parece que la experiencia haya sido muy positiva para reducir ni la prostitución ni la actividad de las mafias. Un caso diferente es el de Suecia, que optó por prohibirla y criminalizar las mafias y los clientes. De esta manera, y si las cifras no mienten, ha conseguido que la prostitución bajara entre un 30% y un 50%.
Las prostitutas libres dirán que con qué derecho una sociedad que se proclama liberal interfiere en las vidas de las personas, condena la prostitución y la considera un trabajo indigno. La respuesta es que, en efecto, es una actividad degradante para todas las mujeres que no entienden que el ejercicio de la prostitución reafirma sus derechos como individuos libres, sino todo lo contrario, y estas son desgraciadamente las que más abundan.
La discrepancia de puntos de vista sobre este tema nos sitúa ante una de las paradojas del liberalismo. La paradoja que consiste en colocar en un pedestal la libertad de los individuos sin atender las condiciones imprescindibles para que la libertad no sea un derecho sólo formal, sino que tenga la base material imprescindible para poder ejercerlo.
Por otro lado, nos cansamos de decir que también la libertad debe tener límites, pero no lo ratificamos nunca en la práctica. Hace unos días, la Asamblea Nacional francesa aprobaba considerar delito la incitación a la delgadez extrema prohibiendo a las agencias de modelos contratar jóvenes exageradamente delgadas. Cuando uno puede elegir, es libre de hacerse daño a sí mismo, pero el primero es conseguir que la libertad de elegir sea real, poder comparar entre diferentes formas de vida y escoger la preferida. Cuando deje de haber prostitutas obligadas a serlo, podremos discutir si nos parece aceptable sustituir la palabra prostitución por la de trabajadoras sexuales.
